Using business contacts in Czechia
Act No. 480/2004 Coll. covers unsolicited commercial electronic communications sent to users who can be natural or legal persons. For a recipient who is not your customer, prior demonstrable consent is the operative route. The customer exception is limited to your own similar products or services and remains subject to a simple, free refusal. A public company address, ARES match, generic inbox, or legitimate-interest analysis is not a substitute for the electronic-marketing rule.
Read the Czech authority's Act 480/2004 guidance- Keep attributable evidence showing who consented, which sender received the permission, and what commercial communication it covers. The sender bears the burden of proving valid consent.
- Do not send a first promotional message merely to request consent. Czech authority guidance treats consent as something the recipient actively gives before the commercial communication.
