Using business contacts in Romania
Article 12 of Law 506/2004 requires prior express consent for unsolicited commercial communication by email, fax, automated calling systems and other covered electronic methods. Its existing-customer exception is limited to similar products or services where the address was collected directly during a sale and clear, free opt-outs were offered. Company status, a public mailbox or legitimate interests under GDPR does not replace this channel requirement.
Read Romania's electronic-communications law and ANSPDCP guidance- Use unsolicited email only where prior express consent can be demonstrated or every condition of the statutory existing-customer exception is documented.
- Do not treat a Trade Register match, company domain, role inbox, publication on a website, or purchased-list source as consent.
- Identify the real sender, describe the commercial offer accurately, and include a valid, simple address or mechanism for stopping messages.
- When a field identifies a person, document a GDPR legal basis, provide Article 13 or 14 information as applicable, minimize and maintain the data, and respect the absolute direct-marketing objection.
- Record withdrawals and objections in a suppression list and screen every future campaign against it.
