Using business contacts in New Zealand

A public or purchased email address is not blanket permission to send commercial messages. New Zealand's Unsolicited Electronic Messages Act requires express, inferred, or deemed consent. Deemed consent applies only when the address was conspicuously published by the person in a business or official capacity, no statement rejects unsolicited messages, and the message is relevant to that person's business role or duties. The sender carries the burden of proof.

  • Keep recipient-level evidence of express or inferred consent, or retain the original publication and document every condition relied on for deemed consent.
  • Check the source for a no-marketing statement and make the offer directly relevant to the published business, role, function, or duty.
  • Identify the authorizing business accurately and provide contact information that remains valid for at least 30 days after the message is sent.
  • Include a clear, free, functional unsubscribe method and action requests within five working days.
  • Do not use address-harvesting software or lists created with it to send unsolicited commercial electronic messages.
  • When a record is personal information collected indirectly, assess Privacy Act principle 2 and provide the IPP3A notice unless a statutory exception applies; IPP3A has applied to new indirect collection since 1 May 2026.
  • Maintain a suppression list so an unsubscribe or objection is not reintroduced during a later refresh.
  • The electronic-message consent rules do not create permission for unrelated contact channels. For business calls, identify the caller, keep the purpose relevant, apply the Privacy Act when a number identifies an individual, and stop calling after an objection.
