Using restaurant contacts in Ireland
Irish ePrivacy rules distinguish the recipient and the context. Unsolicited email to a natural person can fall within Regulation 13(2) when the address reasonably appears to be used mainly for commercial or official activity and the message relates solely to that activity. Email to an organization other than a natural person is allowed until it has objected. Where a contact identifies a person, GDPR still requires a lawful basis such as properly assessed legitimate interests, transparency, minimization, and an immediate stop after a direct-marketing objection.
Read Ireland's electronic direct-marketing rules- Classify the subscriber and mailbox context; a CRO business-name record can belong to an individual, partnership, or company and is not by itself a corporate-company match.
- For a natural person's business address, retain evidence that it is used mainly in a commercial or official capacity and make the message solely relevant to that activity before relying on Regulation 13(2).
- For organizations other than natural persons, suppress the address as soon as the subscriber or user objects under Regulation 13(4).
- When personal data is involved, document the GDPR lawful basis. If using legitimate interests, record purpose, necessity, expectations, impact, and safeguards, and provide the required transparency information.
- Identify the sender, use a valid contact address, provide a simple cessation route, and never conceal the identity behind the message.
- Apply Article 21 objections immediately and screen every refreshed file against the suppression list.
- For live marketing calls, check the National Directory Database opt-out preference and your own suppression list. Marketing calls to mobile phones require the consent conditions in Regulation 13(6); a public business number is not a blanket channel permission.
