Using restaurant contacts in Argentina

Article 27 of Law 25,326 permits defined direct-advertising uses of suitable data from publicly accessible documents, data supplied by the holder, or consented sources. Keep only the individual data needed for a relevant offer. Every postal, telephone, email, internet, or other remote advertisement must prominently explain how the person can request removal or blocking, and the database source must be identified on request.

  • Retain the public source URL, collection date, venue category, and reason the proposed offer is relevant to that business.
  • Use only the contact and segmentation fields needed to formulate the offer; do not infer personal preferences, ownership, or decision-making roles from a venue listing.
  • Identify the advertiser and include a prominent, workable route to request total or partial removal or blocking in every remote marketing communication.
  • Be able to identify the controller or database user that supplied the information when the recipient asks.
  • Correct, update, block, or suppress inaccurate and objected-to records, and prevent a later file refresh from restoring them to outreach.
  • Register and govern any personal-data database when the current AAIP rules require it; purchasing a CSV does not transfer the seller's compliance record to the buyer.
  • Before calls or promotional messages to telephone lines, screen the National Do Not Call Registry and your own suppression list. Resolution 126/2024 requires advertisers to consult the registry at least every 30 calendar days before contact; a public business number is not an exception.
