Using business contacts in Finland

Under Finland's Act on Electronic Communications Services, electronic direct marketing to a natural person generally requires prior consent. Marketing to a community or legal entity is generally permitted unless expressly prohibited. Processing information that identifies a person also needs a GDPR lawful basis; legitimate interests do not override the channel's consent requirement.

  • Establish the recipient's legal form, subscriber type, and contact route before sending. A business name, custom domain, role inbox, or free-webmail address does not by itself prove the recipient class.
  • A confirmed legal entity's general inbox can generally receive relevant B2B marketing without prior consent, but the sender must be identified and every message must provide an easy, free way to prohibit further marketing.
  • Do not automatically treat a named employee as a legal-entity recipient. Verify the person's actual role and that the offer is materially related to that role before considering contact without consent.
  • Marketing email to a private trader or another natural person requires consent or an existing-customer exception that meets every statutory condition.
  • When a record identifies a person and came from a public or third-party source, document the lawful basis and balancing test, provide Article 14 information, stop direct marketing immediately after an objection, and retain the objection on a reliable suppression list.
  • Telephone marketing is a separate channel. An email classification does not automatically authorize a call, so check who uses the number, previous objections, and the rules applicable to that call before contacting it.
