Using restaurant contacts in Denmark
Section 10 of Denmark's Marketing Practices Act generally requires prior consent for marketing by email, SMS, and other electronic mail. The ban applies to every recipient, including companies, public authorities, and general addresses such as info@. A GDPR legitimate-interest assessment may support processing personal data, but it does not replace the channel's consent requirement.
Read section 10 of the Marketing Practices Act and guidance from the Consumer Ombudsman and Data Protection Agency- Do not treat a public email address as evidence of consent. A CVR match, custom domain, info@ inbox, or free-webmail address does not change section 10's general rule.
- Send electronic marketing only when valid, voluntary, informed, and specific consent can be documented, or when every condition of the existing-customer exception for the sender's own similar products is met.
- Identify the sender, make withdrawal easy and free, and retain opt-outs on a reliable suppression list.
- Where data identifies a person, also document the GDPR basis, provide the required information, and stop direct marketing immediately after an objection.
- Use the list for research, segmentation, and verification, but keep data availability separate from permission for the selected contact channel.
