Using business contacts in Latvia

Section 9 of Latvia's Law on Information Society Services applies its prior-consent and existing-customer restrictions to commercial communications sent to natural persons. Those specific restrictions do not apply in the same way to a legal person, but every commercial message must be recognizable, identify the sender, explain the offer, provide a functioning refusal route, and honor refusals. GDPR applies separately whenever an address or other field identifies a person.

  • Determine whether the address belongs to a legal person, an individual merchant or other natural person, and whether it is tied to the same business; an email domain or public profile category does not establish that status.
  • For a natural-person recipient, do not send unsolicited commercial email without prior free and explicit consent unless every condition of the statutory existing-customer exception is satisfied.
  • For a legal-person mailbox, keep the proposition relevant to the business, make the commercial nature and sender clear, state the offer accurately, and provide a working free refusal route.
  • When the record identifies a person, document the GDPR legal basis and legitimate-interest balancing test where relied upon, provide required transparency, minimize the data, and keep it accurate.
  • Stop direct marketing immediately after an objection or refusal and screen future files against a maintained suppression list.
  • Treat automated calls, fax, email, and other commercial electronic channels under the applicable Section 9 rules. For any channel, use valid sender contact details, make refusal possible, and suppress a recipient after refusal.
